  • If you make a purchase from a Vending Machine in the UK, Emerga Charge Ltd is the primary controller.

  • If you make a purchase from a Vending Machine in Spain, Emerga Charge Ibiza SL is the primary controller.

  • If you contact us for support, the entity you contact will act as primary controller for that interaction.

For UK operations, Emerga Charge Ltd complies with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

For Spanish operations, Emerga Charge Ibiza SL complies with the EU General Data Protection Regulation (EU GDPR) and applicable Spanish data protection law.

2.2 Data Collected Automatically via Vending Machine Transactions


When you make a purchase at one of our Vending Machines, payment is processed by our third-party provider Nayax. Nayax processes your card or contactless payment data directly. Emerga Charge does not receive or store your full card details.

We do receive transaction data from Nayax, which may include:

  • Date, time, and location of the transaction (identified by machine/venue)

  • Product purchased

  • Transaction value

  • A anonymised or tokenised payment reference

We do not receive your name, card number, or billing address from Nayax as part of standard transaction processing.

2.3 Data Collected via This Website

When you visit emergacharge.com, certain data is collected automatically by our website platform (Framer) and any analytics or cookie tools we use. This may include:

  • Your IP address

  • Device type and operating system

  • Pages visited and time spent on the site

Nayax — our payment processing provider, who processes card and contactless payment data at the point of vending machine transaction. Nayax operates under its own privacy policy and is responsible for payment data security.

Framer — our website platform, which may collect usage and analytics data as described in Section 2.3.

Accountants — our selected UK accountancy firm, who may process limited financial data as necessary for accounting and compliance purposes.

Our Spanish gestor (tax adviser) — who may process limited financial and business data for Spanish tax compliance purposes.

Legal and regulatory authorities — where we are required to disclose data by law, court order, or regulatory obligation.

We do not sell, rent, or trade your personal data with any third party for marketing or commercial purposes.

Where we share data with third-party processors, we ensure appropriate data processing agreements are in place.


6. International Data Transfers


Emerga Charge operates in both the United Kingdom and Spain. Personal data may be transferred between these two entities as part of our joint operations.

Where data is transferred from the UK to Spain (or vice versa), we ensure that appropriate safeguards are in place in compliance with UK GDPR and EU GDPR requirements.

If any of our third-party service providers process data outside the UK or European Economic Area (EEA), we ensure this is done in accordance with applicable data protection law, using mechanisms such as Standard Contractual Clauses or adequacy decisions where required.

In the event of a personal data breach that is likely to result in a risk to your rights and freedoms, we will notify the relevant supervisory authority (the ICO in the UK, or the AEPD in Spain) in accordance with our legal obligations, and we will notify affected individuals where required.
